Terms of Use

Welcome to BetInsights ("Platform", "we", "us", or "our"). These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and BetInsights, governing your access to and use of our website, applications, and services (collectively, the "Service").

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages. Please read it at /privacy-policy.

Your agreement with us includes these Terms and our Privacy Policy ("Agreements"). You acknowledge that you have read and understood the Agreements, and agree to be bound by them.

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations of the Federative Republic of Brazil, including but not limited to:

If you do not agree with (or cannot comply with) these Agreements, then you may not use the Service, but please let us know by emailing support@betinsights.com.br so we can try to find a solution. These Agreements apply to all visitors, users and others who wish to access or use the Service.

2.3 Information Purpose Only: All information, analysis, statistics, odds comparisons, and content provided on the Platform are for general informational and educational purposes only. Such information does not constitute and should not be construed as financial advice, investment advice, betting recommendations, or any form of professional guidance.

3.1 General Information Only: We aim to help you make more informed decisions. However, we are not in the business of rendering personalized betting advice. We cannot know all the relevant facts about you and your individual needs, and we cannot claim or represent that any particular bet is suitable for you.

3.2 No Personalized Recommendations: Accordingly, you agree that any information, analysis, or data displayed on the Platform does not constitute a recommendation that a particular bet is suitable for you personally.

3.3 Third-Party Partnerships: We may partner with third parties to facilitate access to betting platforms. We will not, and cannot, bet on your behalf at any sportsbook. Only you can decide whether or not a bet is right for you, and you agree to be solely liable for any bet you initiate with your sportsbook accounts.

4.1 Personal Responsibility: One of the principal tenets at BetInsights is that the best person to handle your bets is you. By using our Service, you agree that you bear full responsibility for your own betting decisions.

4.2 Liability Disclaimer: YOU ALSO AGREE THAT BETINSIGHTS, ITS DIRECTORS, ITS EMPLOYEES, AND ITS AGENTS WILL NOT BE LIABLE FOR ANY BETS MADE OR ACTION TAKEN BY YOU AND OTHERS BASED ON NEWS, INFORMATION, OPINION, OR ANY OTHER MATERIAL PUBLISHED THROUGH OUR SERVICE.

4.4 Past Performance Disclaimer: Any historical data, past results, backtested strategies, or performance metrics displayed on the Platform are provided for informational purposes only. Past performance does not guarantee, indicate, or predict future results.

4.5 Compliance with Lei 14.790/2023: In accordance with Brazilian sports betting regulations, we explicitly state that this Platform does not promote, advertise, or suggest that betting is a source of income, a path to financial success, or a risk-free activity.

5.1 Marketing Communications: By creating an account on our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send, in accordance with LGPD requirements.

5.2 Opt-Out Rights: However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link in any email or by contacting us at support@betinsights.com.br.

5.3 Service Communications: You acknowledge that we may send you essential service-related communications (such as security alerts, account notifications, and billing information) that are not subject to opt-out preferences.

6.1 Age Requirement: Service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using the Service, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into these Agreements and abide by these Terms. If you are not at least eighteen (18) years old, you are prohibited from both accessing and using the Service.

6.2 Account Creation: When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

6.3 Account Security: You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

6.4 Username Restrictions: You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.

7.1 Subscription Billing: Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

7.2 Automatic Renewal: At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it. You may cancel your Subscription renewal through your online account management page or by contacting our customer support team.

7.3 Payment Information: A valid payment method is required to process the payment for your subscription. You shall provide us with accurate and complete billing information including full name, address, state, postal code, telephone number, and valid payment method information. By submitting such payment information, you automatically authorize us to charge all Subscription fees incurred through your account to such payment instruments.

7.4 Failed Payments: Should automatic billing fail to occur for any reason, we will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

7.5 Purchase Verification: If you wish to purchase any product or service made available through Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase. You represent and warrant that: (i) you have the legal right to use any payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

7.6 Order Cancellation: We reserve the right to refuse or cancel your order at any time for reasons including but not limited to product or service availability, errors in the description or price of the product or service, errors in your order or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

8.1 Free Trial Offer: We may, at our sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial").

8.2 Billing Information: You may be required to enter your billing information in order to sign up for the Free Trial.

8.3 Automatic Conversion: If you do enter your billing information when signing up for the Free Trial, you will not be charged until the Free Trial has expired. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.

8.4 Modification Rights: At any time and without notice, we reserve the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.

8.5 Multiple Trials Prohibited: You may not sign up for more than one Free Trial using the same or different accounts.

9.1 Right to Modify: BetInsights, in its sole discretion and at any time, may modify Subscription fees for the Subscriptions.

9.2 Prior Notice: Any Subscription fee change will become effective at the end of the then-current Billing Cycle. We will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

9.3 Acceptance of Changes: Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

10.1 General Policy: Except when required by law, paid Subscription fees are non-refundable.

10.2 Consumer Rights: In accordance with the Consumer Defense Code (CDC - Lei 8.078/1990), consumers in Brazil have the right to cancel purchases made outside commercial establishments (including online purchases) within 7 (seven) days from the date of purchase or receipt, with full refund of amounts paid. This right of withdrawal applies as provided by Brazilian law.

10.3 Refund Requests: To request a refund under applicable law, please contact us at support@betinsights.com.br with your account details and reason for the refund request.

11.3 No Endorsement: The inclusion of any bookmaker, operator, or betting platform on our site does not constitute an endorsement, recommendation, or guarantee of their services, reliability, or trustworthiness. Users must conduct their own due diligence before engaging with any third-party operator.

11.4 Bookmaker Verification: We endeavor to only display information from bookmakers that hold valid licenses to operate in their respective jurisdictions. However, licensing status may change, and users should independently verify that any operator they choose to use is properly licensed in Brazil (when applicable) or their jurisdiction.

12.1 Content Responsibility: Our Service may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for Content that you post on or through the Service, including its legality, reliability, and appropriateness.

12.2 Content Warranties: By posting Content on or through the Service, you represent and warrant that: (i) Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity.

12.3 Content License: By posting Content on the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post or display on or through the Service.

12.4 Content Monitoring: We reserve the right to monitor, review, edit, or remove Content at our sole discretion, including Content that in our sole judgment violates these Terms, is offensive, illegal, or otherwise objectionable, or violates the rights of any party.

14.1 Third-Party Analytics: We may use third-party Service Providers to monitor and analyze the use of our Service.

14.2 Google Analytics: Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. 14.3 LGPD Compliance: In accordance with the General Data Protection Law (LGPD - Lei 13.709/2018), we will obtain your consent before implementing non-essential tracking technologies. You may manage your cookie and tracking preferences through our cookie consent mechanism.

15.1 Ownership: The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of BetInsights and its licensors. The Service is protected by copyright, trademark, and other laws of Brazil and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of BetInsights.

15.2 Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

15.3 Third-Party Content: Odds data, statistics, and other content sourced from third-party providers remain the property of their respective owners. Our display of such content does not transfer any ownership rights to you.

15.4 Copyright Policy: We respect the intellectual property rights of others. If you believe that any content on the Service infringes your copyright, please contact us at legal@betinsights.com.br with a detailed description of the alleged infringement.

16.1 Confidential Information: "Confidential Information" means any information disclosed by either party that is marked as confidential or would reasonably be considered confidential given the nature of the information and the circumstances of disclosure.

16.2 Obligations: Each party agrees to: (i) protect the confidentiality of the other party's Confidential Information using the same degree of care that it uses to protect the confidentiality of its own confidential information of like kind (but in no event less than reasonable care); (ii) not use any Confidential Information for any purpose outside the scope of these Terms; and (iii) not disclose Confidential Information to any third party.

16.3 Prohibited Actions: You agree not to disclose, share, sell, or otherwise distribute any proprietary algorithms, analysis methods, or data processing techniques used by the Platform.

17.1 Third-Party Links: Our Service may contain links to third-party web sites or services that are not owned or controlled by BetInsights.

17.2 No Control: BetInsights has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party web sites or services.

17.3 No Endorsement: We do not warrant the offerings of any of these entities/individuals or their websites. Links to third-party bookmakers or betting operators are provided solely for your convenience and do not constitute an endorsement of their services.

17.4 Acknowledgement: YOU ACKNOWLEDGE AND AGREE THAT BETINSIGHTS SHALL NOT BE RESPONSIBLE OR LIABLE, DIRECTLY OR INDIRECTLY, FOR ANY DAMAGE OR LOSS CAUSED OR ALLEGED TO BE CAUSED BY OR IN CONNECTION WITH USE OF OR RELIANCE ON ANY SUCH CONTENT, GOODS OR SERVICES AVAILABLE ON OR THROUGH ANY SUCH THIRD-PARTY WEB SITES OR SERVICES.

18.1 Feedback: You may provide us either directly at support@betinsights.com.br or via third-party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our Service ("Feedback").

18.2 Feedback Rights: You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) BetInsights may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party.

18.3 Feedback License: In the absence of any agreement to the contrary, BetInsights shall be entitled to unrestricted use of the Feedback for any purpose whatsoever, commercial or otherwise, without acknowledgment or compensation to you.

19.1 Termination by Us: We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

19.2 Termination by You: If you wish to terminate your account, you may simply discontinue using the Service, or contact us at support@betinsights.com.br to request account deletion in accordance with LGPD requirements.

19.3 Survival: All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

20.1 As-Is Basis: THESE SERVICES ARE PROVIDED BY BETINSIGHTS ON AN "AS IS" AND "AS AVAILABLE" BASIS. BETINSIGHTS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THEIR SERVICES, OR THE INFORMATION, CONTENT OR MATERIALS INCLUDED THEREIN.

20.2 No Warranties: YOU EXPRESSLY AGREE THAT YOUR USE OF THESE SERVICES, THEIR CONTENT, AND ANY SERVICES OR ITEMS OBTAINED FROM US IS AT YOUR SOLE RISK. NEITHER BETINSIGHTS NOR ANY PERSON ASSOCIATED WITH BETINSIGHTS MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES.

20.3 No Accuracy Guarantees: WITHOUT LIMITING THE FOREGOING, NEITHER BETINSIGHTS NOR ANYONE ASSOCIATED WITH BETINSIGHTS REPRESENTS OR WARRANTS THAT THE SERVICES, THEIR CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED.

20.4 Full Disclaimer: BETINSIGHTS HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

21.1 Maximum Liability: EXCEPT AS PROHIBITED BY LAW, BETINSIGHTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

21.2 Betting Losses: UNDER NO CIRCUMSTANCES SHALL BETINSIGHTS BE LIABLE FOR ANY LOSSES, DAMAGES, OR CLAIMS ARISING FROM: (i) YOUR BETTING DECISIONS OR GAMBLING ACTIVITIES; (ii) RELIANCE ON ANY INFORMATION, ODDS, STATISTICS, OR ANALYSIS PROVIDED ON THE PLATFORM; (iii) THE ACCURACY OR INACCURACY OF ANY DATA DISPLAYED.

21.3 Third-Party Actions: BETINSIGHTS SHALL NOT BE LIABLE FOR ANY ACTS, OMISSIONS, OR CONDUCT OF ANY THIRD-PARTY BOOKMAKER, BETTING OPERATOR, OR SERVICE PROVIDER.

21.4 Technical Issues: BETINSIGHTS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM TECHNICAL FAILURES, SERVER DOWNTIME, DATA LOSS, OR INTERRUPTIONS IN SERVICE.

21.5 Aggregate Liability: IN NO EVENT SHALL BETINSIGHTS' AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO BETINSIGHTS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR R$100.00 (ONE HUNDRED BRAZILIAN REAIS), WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless BetInsights and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (a) your use and access of the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your Content caused damage to a third party.

23.1 Right to Modify: We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice.

23.2 No Liability for Changes: We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.

23.3 Access Restriction: From time to time, we may restrict access to some parts of the Service, or the entire Service, to users, including registered users.

24.1 Governing Law: These Terms shall be governed and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law provisions.

24.2 Jurisdiction: Any disputes arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Brazil.

24.3 Consumer Protection: Nothing in these Terms shall affect the rights of consumers under the Consumer Defense Code (CDC - Lei 8.078/1990), including the right to bring claims in the consumer's domicile.

24.4 Dispute Resolution: Before filing any legal claim, you agree to first contact us at legal@betinsights.com.br to attempt to resolve the dispute informally. We will attempt to resolve any disputes within 30 (thirty) business days.

25.1 Right to Amend: We may amend these Terms at any time by posting the amended terms on this site. It is your responsibility to review these Terms periodically.

25.2 Material Changes: We will provide notice of material changes to these Terms by posting a notice on the Service or by sending you an email. Your continued use of the Platform after the revised Terms become effective indicates that you have read, understood, and agreed to the current version of the Terms.

25.3 Version Control: The date of the last revision is identified at the top of these Terms. We recommend you periodically review these Terms to stay informed of updates.

26.1 Waiver: No waiver by BetInsights of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of BetInsights to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

26.2 Severability: If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

27.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the sole and entire agreement between you and BetInsights with respect to the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

27.2 Assignment: BetInsights may assign or transfer these Terms, in whole or in part, without restriction. You may not assign or transfer any rights or obligations under these Terms without our prior written consent.

27.3 No Third-Party Beneficiaries: These Terms do not confer any third-party beneficiary rights. No third party shall have any right to enforce any provision of these Terms.

27.4 Electronic Communications: By using the Service, you consent to receiving electronic communications from us. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
